We here at Hibberd’s List understand the need and respect every individual's right to privacy. Our relationship
with you is a valuable asset. We understand the importance you place on the privacy and security of information that personally
identifies you or your account information. We refer to and treat this information as "personal information." The following
Privacy Policy explains our information gathering and dissemination practices. It refers to our subscribers ("Subscribers"),
organizations hosting events and using Hibberd’s List ("Hosts") or both ("Users").
If you choose to visit Hibberd’s List, your visit and any dispute over privacy is subject to this Privacy Policy
and our User Agreement, including limitations on damages, arbitration of disputes, and application of the law of the state
of New Jersey. Click here for our User Agreement. If you have any concern
about privacy at Hibberd’s List, please send an e-mail to us at publisher@HibberdsList.com and we promise to respond back quickly.
Our privacy policy may change from time to time. If we make any material changes to it in the future, substantive
changes will be posted on our site in this location, and the date of the changes will be noted on the Web site for a period
of time. Your continued use of the site after the changes are posted constitutes your agreement to the changes with regard
to information collected in the past and in the future from you. If you do not agree to the changes, you may cancel your subscription
by sending an e-mail to us at publisher@Hibberdlist.com with the words “unsubscribe” at any time.
Please be aware that Hibberd’s List is not intended for children under the age of 18. If you are an international User, by registering with Hibberd’s List and using the service, you agree
that Hibberd’s List may collect, use, and transfer your Data as described in this Privacy Policy.
1. Collected Information
a. Our Users
We do not at present, but may at some time in the future, automatically track certain information
based upon your behavior on our site. This information may include the URL that you just came from (whether this URL is on
our site or not), the URL you go to next (whether this URL is on our site or not), what browser you are using, and your IP
address. To help us make emails more useful and interesting, we may receive a confirmation when you open email from Hibberd’s
List if your computer supports such capabilities. When we send messages to you or others, we may provide a URL link to the
Hibberd’s List site that contains an alphanumeric identifier, which allows us to identify the person to whom we sent
the message so that we can personalize our content for that individual.
Hibberd’s List may also use pixel tags to gather information about the emails we send to
our Subscribers and to recipients of messages. Pixel tags are tiny graphic files, not visible to the human eye, that are included
in our HTML-encoded email messages. When such a message is opened in an HTML-capable email program, the recipient's computer
will access our server to retrieve the pixel tag file, allowing us to record and store, along with your email address, the
date and time the recipient viewed the material, that the recipient's email program is capable of receiving HTML-encoded email,
and other standard logging information. The pixel tag also may see or read cookies.
Hibberd’s List may also place a "cookie" in the browser files of your computer. The cookie
itself does not contain any personal information although it will enable Hibberd’s List to relate your use of our web
page to information that you specifically provided to us. Hibberd’s List uses cookies to personalize our page so that
we can better serve you when you return to our site. We may also use cookies to allow you to enter your password less frequently
during a session. Most cookies are "session cookies," meaning that they are automatically deleted from your hard drive at
the end of a session. The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting
new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.
If you send us personal correspondence, such as emails or letters, or if you use our site to critique
any of the posted events (a future feature planned for our site) or if other Users or third parties send us correspondence
about your activities on the Site, we may collect such information in a file specific to you. When Subscribers send messages
to others through our service (e.g., a Hibberd’s List invitation or a reminder), we collect and retain the email addresses
of those persons to whom you send the message. We will NOT collect any information about you from other sources and add it
to our account information. Hibberd’s List will not correlate your Data with any information held by third parties,
such as advertising companies. Our sole source of Data is our Subscribers.
b. Subscribers
When you register with HibberdsList® service as a Subscriber, our registration form requires you
to give us your email address, geographic information corresponding to the region in which you may expect to attend events
(postal/zip code and country), gender, year of birth, and a name for us to address you by (e.g., your nickname or first name).
We also ask for optional profile data such as your professional event interests and demographic information.
c. Hosts
Any organization or individual who wishes to be included in Hibberd’s List is required to
give us his/her name, name and street address of the group(s) hosting the event, and contact phone number. Hibberd’s
List will also collect other information that Hosts volunteer to us through use of our service, such as additional information
on the group etc. You may always choose not to provide such voluntary information to us; however, this may limit our ability
to provide you with a specific service. Hosts should also note that submittal of information concerning the host organization
or a planned event does not insure that information will be included on Hibberd’s List or included on the site. Hibberd’s
List reserves the sole and exclusive right to accept or reject information or material for its Hibberd’s List and website.
We also collect Subscribers' comments about you and your events when Subscribers provide them
to us. If you establish a credit account with us to pay the fees we may charge, we will of course collect some additional
information, including billing address, credit card number and expiration date, and tracking information for checks or money
orders.
2. Our Use of Your
Information
Our primary goal in collecting personal information is to provide Users with a professional, efficient,
and customized use of the information we provide. This allows us to provide services and features that most likely meet your
needs, and to customize our service to make your experience easier. The information described above is referred to collectively
in this policy as "Data."
a. All Users
We use the collected information to match Subscribers with events and to operate the Hibberd’s
List service. In addition, we may use the information to provide personalized advertising to our Users or to forward Host’s
invitations to Subscribers. We use contact information if we need to contact Users when necessary. We use your IP Address
to help diagnose problems with our server and to administer our Web site and otherwise provide our service to you. We use
information about your behavior on our site to do internal research on our Users' demographics, interests, and behavior to
better understand and serve you and other Subscribers. You agree that we may use personally identifiable information about
you to improve our marketing and promotional efforts, to analyze site usage, improve our content and product offerings, and
customize our site's content, layout, and services. These uses improve our site and better tailor it to meet your needs.
We use information in the file we maintain about you, and other information we obtain from your
current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our Subscriber Agreement.
At times, we may look across multiple Subscribers to identify problems or resolve disputes.
b. Subscribers
We use only profile information that Subscribers actively provide us with to match them with Host’s
events. We may, in the future, use it to target certain oter, related services or products. Subscriber profile information
is always private and can only be seen by the Subscribers themselves.
c. Hosts
We use only the event profile information with which you actively provide us to match your events
and your preferences for attendees with the profile information of Subscribers. We use your financial information, including
credit card information, to verify your name, address, and other information, and may use it as well to bill you for your
use of our services. We may use your Distribution Lists only to forward your invitations and reminders and to remove duplicates
from the Matching Lists in order to reduce your fees.
3. Disclosure of
Your Information
Our Subscribers' information is critical to our business, and we do not sell or rent any personally
identifiable information about you to any third party. However, the following describes some of the ways that your personally
identifiable information may be disclosed:
a. Law Enforcement and Legal Process
Hibberd’s List cooperates with law enforcement inquiries, as well as other third parties,
to: (1) conform to the edicts of the law or comply with legal process served on us; (2) act under exigent circumstances to
protect the personal safety of its Users or the public; and (3) protect and defend the rights or property of Hibberd’s
List. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
b. Technical Need
Certain technical processing of email messages and their content may be required to: (1) send
and receive messages; (2) conform to connecting networks' technical requirements; (3) conform to the limitations of the Service;
or (4) conform to other similar requirements.
c. Third Parties
Third party service providers may perform functions on our behalf. Examples include sending email,
analyzing data, providing marketing assistance, processing billing and payments, and providing customer service. They have
access to personal information needed to perform their functions, but may not use it for other purposes. We aggregate (gather
up Data across all User accounts) personally identifiable information and disclose such information in a non-personally identifiable
manner to advertisers and other third parties for other marketing and promotional purposes. However, in these situations,
we do not disclose to these entities any information that could be used to identify a User personally. Only information about
a User's visit to this site, such as number of times an ad is viewed, may be used to serve ads to Users on this site. Certain
information, such as email addresses and passwords are never disclosed to marketing advertisers. Similarly, Hibberd’s
List may disclose aggregated User statistics (for example, as a hypothetical, that 71% of Subscribers are 35-55 years old)
in order to describe ourselves to prospective partners, advertisers, other third parties, Users, and for other lawful purposes.
It is possible that Hibberd’s List could merge with or be acquired by another business entity. Should such a combination
occur, you should expect that Hibberd’s List would share some or all Subscriber Data in order to continue to provide
the service. You would receive notice of such event (to the extent it occurs) as provided in the Subscriber Agreement ("Notice")
and we will require that the new combined entity follows the practices disclosed in this Privacy Policy.
4. Your Use of Other
User's Information
Hibberd’s List serves a professional audience and we will not tolerate spam (unsolicited
e-mails). Therefore, without limiting the foregoing, no User is licensed to add a Hibberd’s List User - even Subscribers
who have responded to your invitation or Hosts who have invited you to an event
- to your distribution list (email or physical mail) without their express consent after adequate disclosure. To report Hibberd’s
List-related Spam to us, please send an email to publisher@HibbersList.com.
5. Use of Email Tools
Should you decide to contact us through our contact form, we require your name and email address
and will only use that information to send you a reply. If you provide the email address of a friend as part of a referral
program, Hibberd’s List will not sell, disclose or share the email addresses and additional information you provide
to any third party, except to the extent that Hibberd’s List shares the email addresses on a strictly confidential basis
with the service provider that assists Hibberd’s List in forwarding such emails on your behalf. Please refer and send
an email only to those persons with whom you have either personal or professional relationships and who you feel would be
interested in subscribing to Hibberd’s List. We do not permanently store the email messages or the email addresses and
we do not use that email addresses for any purpose other than to send your email.
6. Control of Your
Password
Hibberd’s List and your Subscriber registration information is password-protected so that
you and only you have access to our service and your personal information. We request that you do not divulge your password
to anyone. Hibberd’s List will never ask you for your password in an unsolicited phone call or unsolicited email. Also
remember to log out of your Hibberd’s List account and close your browser window when you have finished reviewing and/or
printing needed information. This is to ensure that others cannot access your personal information and correspondence if you
share a computer with someone else or are using a computer in a public place. Ultimately, you are solely responsible for maintaining
the secrecy of your password and maintaining the integrity of our Subscriber Agreement with you. If you lose control of your
password, you may lose substantial control over your personally identifiable information. Therefore, if your password has
been compromised for any reason, you should immediately change your password.
7. Reviewing and
Changing Your Personally Identifiable Information
Subscribers can submit, review, and change their profile information through the following method:
1. Visit www.HibberdsList.org and log in.
2.
Click on the link to the corresponding section of your profile.
3. Change the relevant information and submit your changes.
You can change all profile information with the exception of your email address, using this method.
You can notify us of a change in your email address by emailing info@Hibberdslist.com. We will send
you a confirmation of the change both to your old and your new email address. Upon your request, we will deactivate your account,
contact information, and financial information from our active databases. To make this request, simply send an email with
"unsubscribe" in the subject line to publisher@HibberdsList.com.
In some rare circumstances, we will retain in our files information that you have asked us to
remove in order to, for example, resolve disputes, troubleshoot problems or enforce our Subscriber Agreement. Furthermore,
some such information is never completely removed from our databases due to technical and legal constraints, for instance,
stored "back up" systems. Therefore, you should not expect that all of your personally identifiable information will be completely
removed from our databases in response to your requests.
8. Other Entities
Collecting Information
Except as otherwise expressly included in this Privacy Policy, this document only addresses the
use and disclosure of information that we collect from you. To the extent that you disclose your information to other parties,
whether they are Subscribers or Hosts using Hibberd’s List or our Site or other sites throughout the Internet, different
rules may apply to their use or disclosure of the information that you disclose to them. Third-party advertising companies
used by us may read or set cookies on your hard drive, use pixel tags, track the ads you view, or collect other information
about you. While we may use cookies and pixel tags in other parts of our Site and in emails, cookies and pixel tags from our
ad companies are registered by them, and we do not have access to this information.
Since Hibberd’s List does not control the privacy policies of third parties, you are subject
to the privacy policies of all third parties. The same is true for other websites that we link to throughout our Site and
our Emails.
9. Security
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As
a result, while we strive to protect your personal information, Hibberd’s List does not promise, and you should not
expect, that your personally identifiable information or private communications will always remain private. However, once
we receive your transmission, we make our best effort to ensure its security on our system.
